Introduction

These Terms of Use (hereinafter referred to as "these Terms") are an agreement between you (hereinafter referred to as "you", "you" or "user") and Cikck.com and its affiliates (collectively referred to as "Cikck", "we" and "our"). This Agreement applies to all users or viewers who visit Cikck's website or website that references or links to this Agreement.

Before creating an account on Cikck's website or website or using Cikck's services, you should carefully read and fully understand all the terms and conditions of this Agreement, especially the terms regarding service fees, applicable laws, dispute resolution, exemption or limitation of Cikck's liability, and your rights and obligations.

When you click "Agree" on the relevant webpage/on the website and/or create and use a user account (hereinafter referred to as "Account"), it means that you have read, understood and agreed to this Agreement and agree to be bound by its terms. If you do not agree to this Agreement, you have the right to exit and stop using Cikck's services.



User Accounts, Information Accuracy and Account Security

a. Creating an Account

When accessing and using the Cikck website and certain features and services it provides (collectively, "Cikck Services"), you may need to register a user account and submit necessary personal identification information.

Once an account is successfully created, you can use the account to access and manage various services and features on the Cikck website, including browsing orders, tracking logistics, saving shopping preferences, etc.


b. Information Accuracy

We attach great importance to the authenticity and integrity of user data. All account information you provide is only used to verify your identity and improve the service experience, and we will not use it for any unrelated purposes.

You hereby declare and warrant that the account registration information submitted is true, accurate, complete and up-to-date, and you will update your personal information in a timely manner as needed to ensure the continued validity of the information.

You shall not register an account using false, misleading or impersonating other people's identity information (including but not limited to user name, avatar or contact information), whether the impersonation object is real or fictitious.

If we believe that the information you provide contains false, outdated or misleading content, Cikck reserves the right to suspend or terminate your use of the service without further notice.

c. Account Security

To protect your account, you may need to set up a username, password, and other authentication information. You are responsible for keeping this information safe and are fully responsible for all operations performed through your account.

Do not use another person's account to log in to the service, and do not share, transfer, or authorize others to use your account information in any way. In addition, you may not circumvent or interfere with any authentication mechanism to try to gain unauthorized access.

If you find that your account has unauthorized use, password leakage, or other security anomalies, please notify us immediately. Although we will take reasonable measures to ensure system security, Cikck will not be responsible for any losses caused by your failure to properly keep your account information.

At the same time, if your account is abused and causes losses to Cikck or its affiliates, employees, consultants, agents, etc., you may need to bear corresponding responsibilities and compensation for this.



Privacy Statement and Cookies

By using Cikck's services, you declare and warrant that you have read, understood and agreed to our Privacy Statement.

This is explained in more detail in the Privacy Policy. Please note that the Cikck website uses cookies to collect certain information from you. Please read and fully understand our Cookie Statement before using the Cikck website.



Eligibility

By accessing and/or using Cikck's services, you represent and warrant that you are eighteen (18) years of age or older and have the legal capacity to enter into and contract under applicable law. If you use Cikck's services on behalf of a business entity, you further represent and warrant that you are authorized to act and enter into contracts on behalf of that business entity.



Purchase and Payment

a. Order and Payment

When you purchase items on the Cikck website, you will be asked to fill in your billing information, shipping address and payment card information (including credit or debit card, collectively referred to as "Payment Card") in order to complete the order checkout.


You hereby represent and warrant that:

  • You are the legal owner of the payment card provided and have the authority to authorize payment;
  • You agree that Cikck has the right to deduct the product fee from the payment card, as well as the taxes, shipping costs and related handling fees that you have been clearly informed of on the checkout page.


b. Order Confirmation and Transaction Process

When you submit an order, it means that you have made an offer to us to purchase the selected products.

The system will automatically send you an order confirmation email to confirm that we have received your order request and list the order details.

Please note: This confirmation email does not mean that we have accepted the order or completed the sales contract.


The sales contract between the two parties is only formally established when we complete the order processing and send the goods and you receive a shipping confirmation email.

Cikck reserves the right to refuse or cancel the order under the following circumstances, including but not limited to: insufficient inventory of goods, payment failure, or abnormal transaction behavior.


c. Refund and Return Policy

We hope that you are satisfied with every item you purchase. If you are not completely satisfied with the product after receiving it, you can apply for a return within 30 days from the date of receipt of the product:

  • The product must be unused and come with the original packaging and meet our return requirements;
  • Please contact our customer service team by email to obtain the return address and handling procedures;
  • Once we receive and accept the returned product, we will arrange a refund for you as soon as possible.

After the 30-day return period, if the product has quality problems, you can get after-sales support through our product warranty policy.



License to use the service

Subject to your compliance with all terms and conditions of this Agreement, Cikck grants you a limited, non-exclusive, non-transferable, revocable at any time, and non-sublicensable license to access and use Cikck's website and the services it provides (collectively referred to as "Cikck Services") for your personal, non-commercial purposes.


This license does not include any of the following actions, and you may not:

  • Republish any content in Cikck Services (including but not limited to republishing on other websites or platforms);
  • Sell, rent, lend or sublicense any content in Cikck Services;
  • Publicly display or disseminate content on Cikck websites, whether online or offline;
  • Copy, copy, plagiarize or otherwise use content in Cikck Services for any commercial purpose;
  • Modify, edit, translate, reverse engineer, decompile or otherwise change any content in Cikck Services;
  • Redistribute content in Cikck Services (unless we explicitly allow such behavior and indicate it on the relevant page or service).

Unless explicitly stated, the intellectual property rights of all content in Cikck Services (including but not limited to text, images, videos, icons, logos, designs, interfaces and underlying codes, etc.) belong to Cikck or its legal licensors and are protected by copyright, trademarks, trade dress and other applicable laws.

This Agreement does not expressly grant you any rights other than the above license, and we reserve all rights not expressly granted in this Agreement.



Assumption of Risk and Release

You are aware of and willing to assume all risks when using Cikck Services. On behalf of yourself, your personal representatives and your successors, you voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Cikck and its owners, officers, directors, employees, agents, affiliates, consultants, representatives, sublicensees, successors, assigns, parents, subsidiaries and related entities (collectively, "Cikck") from any and all claims, actions or losses resulting from your use of Cikck Services, including personal injury, property damage, wrongful death, emotional distress, loss of privacy or other damages or harm, whether to you or a third party.



Prohibited Behavior

To protect the legitimate rights and interests of all users and service security, you must comply with the usage regulations in these Terms when accessing or using Cikck services. We have a "zero tolerance" policy for abuse, illegal use, and malicious interference with services. Any violation of the following provisions may result in us restricting or terminating your account access rights and may incur civil or criminal liability.


You may not use Cikck services in any way to engage in the following behaviors:

  • Damage, destroy or interfere with the normal operation of Cikck services, or affect their availability, stability and accessibility;
  • For any illegal, fraudulent, harmful or unethical purpose, including assisting others in carrying out such activities;
  • Disseminate any content containing viruses, spyware, Trojans, worms, keyboard loggers or other malware;
  • Unauthorized copying, storage, hosting, dissemination, publication or distribution of any information or content that violates laws and regulations.


You may not conduct any of the following system or data-related activities on the Cikck platform:

  • Unauthorized automated operations, including but not limited to crawling, data mining, data crawling, batch collection, etc.;
  • Access, tamper with or attempt to access accounts, data or servers that you do not have access to;
  • Detect, scan or test the security or vulnerabilities of the platform system or network, or destroy the authentication mechanism;
  • Attempt to interfere with, hinder or disrupt the normal use of the platform by other users (for example, through denial of service attacks, spam requests, etc.);
  • Forge or tamper with any protocol data, header or meta information related to network communication (such as HTTP Header, IP data packet);
  • Create fake accounts for self-promotion, brushing, inducing users or engaging in commercial profit;
  • Pay others in any form to induce them to interact with your behavior on the platform.

It is strictly prohibited to transmit or send unsolicited commercial advertisements, spam or promotional information through Cikck services.

Without our express written authorization, you may not use the platform for marketing, advertising, promotion or resale of any product or service.


We have the right to take the following measures against users who violate these Terms, including but not limited to:

  • Suspend or terminate account access;
  • Delete illegal content or restrict content display;
  • Report suspected illegal behavior to law enforcement agencies;
  • Pursue liability for losses caused to Cikck or other users due to violations.



Comments, opinions, communications and other content

In these Terms, "your user content" means all materials and information you post on the Cikck platform or any public forum, social media, comment area and other channels related to Cikck, including but not limited to text, images, audio, video and other audio-visual content, for evaluation, comment, feedback or interaction with us.

You grant us a worldwide, irrevocable, non-exclusive, royalty-free license and sublicensable rights to use, copy, adapt, publish, translate and distribute your user content in any existing or future media related to the Service and Cikck's business, including but not limited to promoting and redistributing part or all of the Service. This license does not grant us any right or license to use your content independently of the Service. You also grant us the right to bring lawsuits against third parties for infringement of these rights without your explicit permission.

You warrant that User Content is not illegal, does not infringe the legal rights of any third party, and will not give rise to legal action against you, us or a third party (under applicable law). You must not submit any User Content to the Cikck Service that has been or is the subject of any threatened or actual legal action or other similar complaint.

We reserve the right at all times in our sole discretion to edit or remove any material submitted to the Cikck Service, stored on our servers or posted.

Notwithstanding our rights under these Terms of Use in relation to User Content, we do not undertake to monitor the submission of such content to or posting on the Cikck Service, and we are not responsible for any User Content.



No Warranties; Limitation of Liability

a. No Warranties

We, on our own behalf and on behalf of our licensors and suppliers, expressly disclaim any and all warranties, express or implied, regarding the Cikck Service, whether arising by operation of law or otherwise, including, without limitation, any and all implied warranties of merchantability, fitness for a particular purpose, non-infringement, freedom from encumbrances or title, and any warranties arising from a course of dealing, usage or trade practice. Neither we nor our licensors or suppliers warrant that the Cikck Services will meet your requirements or that the operation of the Cikck Services will be uninterrupted or error-free. We assume no implied liability for any damages arising out of the provision of the Cikck Services under this Agreement, including, but not limited to, errors, omissions, interruptions, delays, tortious acts, mistakes, statements or other defects arising from the failure to provide the Cikck Services (whether caused by act or omission) or any other damages that occur. We will not be liable for any indirect, incidental, special, consequential or punitive damages (including, but not limited to, lost profits or lost revenue), regardless of whether such damages are caused by the acts or omissions of us, Cikck, our users or their agents or representatives.


b. Your liability for loss or corruption of data; data backup.

You agree to use the Cikck Services at your own risk. You shall not hold us or our licensors and other partners (as the case may be) liable for any loss or damage resulting from your access to and/or use of the Cikck Services, including, without limitation, any loss or damage to any of your computers, mobile devices (including, without limitation, tablets and/or smartphones), or data. The Cikck Services may contain bugs, errors, problems, or other limitations.


c. Limitation of Liability

In no event shall we or our licensors or other partners be liable for any claim arising out of your use of the Cikck Services, including, without limitation, special, incidental or consequential damages, loss of profits, loss of data or confidential or other information, loss of privacy, costs of procurement of substitute goods or services, failure to meet any obligation (including, without limitation, duty of good faith or reasonable care, negligence or otherwise), whether or not such damages were foreseeable and regardless of whether any advice or notice given to us or our licensors and other partners arising out of or in connection with your use of the Cikck Services was foreseeable. This limitation applies whether the damages arise out of breach of contract, tort, or any other legal theory or form of action. You agree that this limitation of liability represents a reasonable allocation of risk and is a fundamental element of the basis of the bargain between you and us. Cikck's Services would not be provided without such limitations.


d. Application of Disclaimers

The above disclaimers, waivers and limitations of liability do not in any way limit any other disclaimers or any other limitations of liability in any other agreement between you and us or between you and any of our licensors and other partners. Some jurisdictions may not allow the exclusion of certain implied warranties or the limitation of certain damages, so some of the above disclaimers, waivers and limitations of liability may not apply to you. Our licensors and other partners are intended third-party beneficiaries of these disclaimers, waivers and limitations of liability. No advice or information, whether oral or written, obtained by you through Cikck's Services or otherwise shall alter any of the disclaimers or limitations set forth in this section.


e. No Advice

Nothing in the Cikck Services constitutes, or is intended to constitute, any form of advice. If you need any legal, financial or medical advice, please consult an appropriate professional.



Consent to receive our electronic communications

By creating an account and providing us with your email address, you expressly consent to receive short-term and periodic electronic and other communications, including email communications, from all Cikck brands. These communications will involve your purchase history, customer service inquiries, etc.

In addition, we may use the email address you provide to us or any other appropriate means to send or display to you information about Cikck Services, upcoming promotions and other information that may be of interest to you, but we will always obtain your prior opt-in consent to the extent required by applicable law.



Intellectual Property

You represent and warrant that you will comply with all applicable laws and respect the intellectual property rights of others when using Cikck Services. Your use of Cikck Services is always subject to copyright and other intellectual property laws. You agree not to upload, post, transmit, display, perform or distribute any content, information or other materials that infringe any third party's copyright, trademark or other intellectual property or proprietary rights.


a. Trademarks

Cikck and its related logos (collectively, the "Trademarks") are trademarks or registered trademarks of Cikck and are used with our permission. Other trademarks, service marks, graphics, logos and domain names that appear on, through or anywhere related to the Cikck Services may be trademarks of third parties. Neither your use of the Cikck Services nor this Agreement grants you any right, title or interest in the Trademarks or any third-party trademarks, service marks, graphics, logos or domain names, or any license to reproduce or otherwise use them. You agree that any goodwill in the Trademarks generated by your use of the Cikck Services shall belong to Cikck, and you agree to assign all such goodwill to Cikck. You shall not at any time, nor shall you assist others in challenging Cikck's right, title or interest in the Trademarks or their validity.


b. Copyright

All content and other materials available through the Cikck Services, including but not limited to logos, designs, text, graphics and other files, and their selection, arrangement and organization, are owned by Cikck or are the property of our licensors and other partners. Unless expressly provided otherwise, neither your use of the Cikck Services nor this Agreement grants you any right, title or interest in any such materials.


c. Uploaded Content

Users may upload and post content to Cikck's Services. Such content may appear in the form of uploading 3D printable files and posting other content (such as links, profile information and comments). You represent and warrant that any material you upload or post is your original work or that you have the necessary rights, licenses and permissions to submit such content and can legally grant us the necessary rights to such content. You further represent and warrant that you will not upload content that infringes the rights of third parties or any content that is illegal to possess in your location or that is illegal to display or make available for download on the Site. We reserve the right to refuse or cancel user registration or otherwise restrict access to the Site in our sole discretion.


Users may upload and upload links to the Cikck Services. Linked sites are not under our control and we are not responsible for the contents of any linked site or any link contained in a linked site. We provide links to you only as a convenience and the inclusion of any link does not imply or constitute our endorsement of the site.

You further understand and agree that we cannot guarantee or warrant that files available for downloading through the Cikck Services will be free of infection or viruses, worms, trojan horses or other code that has contaminating or destructive properties. It is your responsibility to implement adequate security measures and procedures to ensure that any files obtained through the Cikck Services are free of such contamination.



Reasonableness

By using Cikck's services, you agree that the exclusions and limitations of liability set forth in this Agreement are reasonable.

If you do not think they are reasonable, you must not use Cikck's services.



Other parties

Cikck's services may be linked to third-party services ("Third-Party Services"), some of which may have an established relationship with us and others of which may not. We have no control over the content and performance of Third-Party Services. We have not reviewed, and cannot review or control, all of the materials, including computer software or other goods or services, available on Third-Party Services. Therefore, we do not represent, warrant or endorse any Third-Party Services, nor do we represent, warrant or endorse the accuracy, currency, content, suitability, legality or quality of the information, materials, goods or services available through Third-Party Services. We are not responsible for, and you agree to assume all responsibility for, any damages or other harm to you or a third party arising from your use of Third-Party Services.

You agree that as a limited liability entity, we have the right to limit the personal liability of its officers and employees. You agree that you will not bring any claim personally against our officers or employees or any Cikck Company for any losses you suffer in connection with the Cikck Services.

Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set forth in this Agreement will protect our officers, employees, agents, subsidiaries, successors, assigns and subcontractors as well as us and Cikck.



Indemnification

Without limiting any indemnification provision of this Agreement, you (the “Indemnifying Party”) agree to defend, indemnify and hold harmless us and Cikck (collectively, the “Indemnified Parties”) from and against any and all claims, actions, demands, causes of action and other proceedings (each a “Claim” and collectively, the “Claims”), including, without limitation, legal costs and expenses, and to provide us with sole and exclusive control over the defense of any action, including the selection of legal counsel and all related settlement negotiations, arising out of or relating to: (i) the relationship between you and us, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory; (ii) your breach of this Agreement, including, without limitation, any representation or warranty contained in this Agreement; (iii) your access to or use of Cikck’s services or products; (iv) your provision of information or other data to us or any Indemnified Party; (v) your violation or alleged violation of any foreign or domestic, international, federal, state or local law or regulation; or (vi) your violation or alleged violation of the copyright, trademark or other intellectual property or proprietary right of any third party.

Each Indemnitee shall have the right (but not the obligation) to participate in your defense of any Claim through counsel of its choice, and you shall defend, indemnify or hold harmless any, each or all Indemnitees from such Claims. You may not settle any Claim without the prior written consent of the relevant Cikck Company.



Termination

Without limiting any other provision of this Agreement, we reserve the right, in our sole discretion, to deny access to the Cikck Services to anyone, without notice or liability, for any reason or no reason, including, without limitation, for breach or alleged breach of any representation, warranty or covenant in this Agreement, or any applicable law or regulation. This Agreement shall terminate automatically if you breach any representation, warranty or covenant in this Agreement. Such termination shall occur automatically and without any action on our part.

Any termination of this Agreement shall automatically terminate all rights and licenses granted to you under this Agreement, including all rights to use the Cikck Services. Upon termination, we may (but have no obligation to) at our sole discretion revoke any Services and/or delete from our systems all of your personal information and any other files or information you have provided to us or related to your use of the Cikck Services. Upon termination, you shall cease to use the Cikck Services.

Upon termination, all rights and obligations arising from this Agreement shall terminate, except that the following provisions shall survive termination of this Agreement.



Applicable Law

This Agreement and any dispute between you and us arising from the use of this Website and the purchase of Products shall be governed by the laws of England without regard to its conflict of law principles.

If any dispute, controversy or claim arises between you and us regarding the interpretation, performance, termination, breach, invalidity or other matters relating to this Agreement, we shall make every effort to resolve it through friendly negotiation. Either party shall notify the other party in writing if it wishes to resolve the dispute through negotiation, and the negotiation shall commence within seven (7) calendar days from the date of the notification.

If the negotiation fails to reach an agreement within a reasonable time, either party may submit the dispute to a competent English court for arbitration. You agree to submit to the exclusive jurisdiction of such court and waive any defense of inconvenient forum.



Assignment

We may assign or otherwise deal with our rights and/or obligations under this Agreement without notifying you or obtaining your consent. You may not transfer or otherwise deal with your rights and/or obligations under this Agreement.



Severability

If any provision of this Agreement is held by any court or other competent authority to be unlawful and/or unenforceable, the remaining provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the remaining provisions will continue in effect.



No Waiver

Any waiver by either party of any term or condition of this Agreement or any breach thereof, in any one instance, will not waive that term or condition or any subsequent breach thereof.



Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and us in relation to your use of Cikck Services, and supersede all prior agreements in relation to your use of Cikck Services.
